Terms of Service

Moistur AI ("the Service") is operated by Moistur AI Private Limited, a company incorporated in India (together with its affiliates, "Moistur AI", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms form a legally binding agreement between you and Moistur AI Private Limited.

Moistur AI provides AI brand intelligence and visibility tracking across major AI platforms including OpenAI (ChatGPT), Anthropic (Claude), and Google (Gemini). The Service allows you to monitor how AI platforms represent your brand, analyze multi-dimensional sentiment, track citation sources, benchmark against competitors, and generate actionable insights.

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity under your account

Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice.

Usage Limits

Each subscription tier includes specific usage limits for prompt executions, API calls, and team members. Exceeding these limits may result in temporary service restrictions until the next billing cycle, or you may upgrade your plan.

Trials and Complimentary Access

Any trial, pilot, or complimentary access is provided at our discretion and may be modified or discontinued at any time. Users on such access are subject to the same Terms as paid users.

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated systems (bots, scrapers) to access the Service beyond the provided API
• Resell, sublicense, or redistribute the Service without written permission
• Upload malicious code, viruses, or harmful content
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use the Service to generate spam, misleading content, or to harass others
• Submit prompts that violate the OpenAI, Anthropic, or Google AI usage policies — including hate or harassing content, sexual content involving minors, requests for instructions to harm people, or content designed to facilitate illegal activity
• Use the Service to generate content intended for downstream attempts to violate any third party's intellectual-property or privacy rights
• Interfere with our right to inspect and pause prompts that have been flagged by a third-party LLM provider's abuse-detection systems; you grant us that right as a condition of using the Service

The Service relies on third-party LLM providers (OpenAI, Anthropic, Google AI) to execute your prompts. If a provider notifies us that prompts originating from your account violate their usage policies, we may immediately suspend your access pending review. We will notify you by email at the address on file within 24 hours of any such suspension and explain the next steps required to restore access. Repeated or severe violations may result in termination under Section 12.

The Service and its original content, features, and functionality are owned by Moistur AI and are protected by international copyright, trademark, and other intellectual property laws.

You retain full ownership of the prompts you create, the brand data you submit, and the insights generated from your data. We may use aggregated, anonymized, non-identifiable data for analytics and service improvements.

The Service integrates with third-party LLM providers (OpenAI, Anthropic, Google AI) and other services. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the content, accuracy, or availability of services provided by third parties. Changes to third-party APIs or policies may affect Service functionality.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted, timely, secure, or error-free service. We may perform scheduled maintenance with reasonable advance notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOISTUR AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Moistur AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

• Material violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees after reasonable notice
• Actions that harm other users or the integrity of the Service

Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination. After 30 days, your data may be permanently deleted.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice in the Service at least 14 days before changes take effect. Continued use after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to the paragraph below, the courts at Gurgaon, Haryana, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of the country in which you reside. Where those laws require, you may bring proceedings in your local courts, and your statutory rights remain unaffected.

We operate from India and offer the Service to customers in India, the United States, the European Union, the United Kingdom, and elsewhere. By using the Service from outside India, you consent to the transfer, storage, and processing of your information in India, the United States, and the EU as described in our Privacy Policy, subject to appropriate safeguards.

• India: we handle personal data in line with the Digital Personal Data Protection Act, 2023 (DPDP).
• EU / UK: where the GDPR or UK GDPR applies, we process personal data on the lawful bases set out in our Privacy Policy and honour data-subject rights (access, rectification, erasure, portability, and objection).
• United States: where state privacy laws such as California's CCPA/CPRA apply, residents may exercise the access, deletion, and opt-out rights described in our Privacy Policy.

You are responsible for complying with the laws that apply to you in your own jurisdiction when using the Service.

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
